These Terms of Service ("Terms" or "EULA") govern your use of the Rainpot mobile application ("App") made available on the Apple App Store and Google Play Store, developed and operated by Khenitech ("Developer", "we", "us", "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You acknowledge that these Terms are concluded between you and Khenitech, and not with Apple Inc. or Google LLC. Khenitech, not Apple or Google, is solely responsible for the App and its content. These Terms may not conflict with the Apple Media Services Terms and Conditions or Google Play Terms of Service, which take precedence in the event of any conflict.
You must be at least 13 years old to use Rainpot. If you are under 18, you must have obtained verifiable parental consent to use the App, as required under the Digital Personal Data Protection Act, 2023 (India). By using the App, you represent that you meet these requirements.
You represent and warrant that: (a) you are not located in a country that is subject to a United States government embargo or that has been designated a "terrorist supporting" country; and (b) you are not listed on any United States government list of prohibited or restricted parties.
Subject to these Terms, Khenitech grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded or Android devices that you own or control, solely for your personal, non-commercial purposes.
This licence is restricted to use on devices owned or controlled by you, consistent with the usage rules set forth in the Apple Media Services Terms and Conditions and the Google Play Terms of Service.
You may not: (a) copy or modify the App; (b) distribute, sell, or sublicence the App; (c) reverse engineer, decompile, or disassemble the App; or (d) use the App in any way that violates applicable law.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account. Notify us immediately at contact@khenitech.com if you believe your account has been compromised.
If you use Sign in with Apple, Apple may provide a private relay email address. We will respect this privacy feature and will not attempt to determine your real email address from the relay. You can revoke Sign in with Apple access at any time from your Apple ID settings.
If you use Google Sign-In, you may revoke access at any time from your Google account settings at myaccount.google.com/permissions.
You retain full ownership of all ideas, notes, voice memos, photos, and other content you create in the App ("Your Content"). Khenitech does not claim any ownership rights over Your Content.
By using the App, you grant Khenitech a limited, non-exclusive, royalty-free licence to store, process, and transmit Your Content solely to the extent necessary to provide the App's features to you. This licence terminates when you delete Your Content or your account.
You are solely responsible for Your Content. You represent that you have all necessary rights to any content you upload and that Your Content does not violate any third-party rights or applicable law.
You agree not to use the App to:
Khenitech is solely responsible for providing maintenance and support services for the App, as required under applicable law and the Apple Developer Program License Agreement. Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the App.
We may update the App from time to time to fix bugs, improve performance, or add new features. Updates may be delivered automatically through the App Store or Play Store.
Khenitech warrants that the App will perform substantially as described in its App Store or Play Store listing. In the event of any failure to conform to this warranty, you may notify Apple (for App Store purchases) and Apple's sole warranty obligation is to refund the purchase price (if any) of the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to this warranty are Khenitech's sole responsibility.
The App is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that the App will be uninterrupted, error-free, or that defects will be corrected.
Khenitech, not Apple or Google, is responsible for addressing any claims you or any third party may have relating to the App or your use of the App, including:
In the event of any third-party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, Khenitech will be solely responsible for the investigation, defence, settlement, and discharge of any such infringement claim. Apple and Google are not responsible for any such claims.
The App and its original content, features, and functionality (excluding Your Content) are owned by Khenitech and are protected by applicable intellectual property laws.
To the maximum extent permitted by the laws of India, Khenitech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the App, including but not limited to loss of data, loss of profits, or loss of content.
Our total aggregate liability to you for all claims arising under or related to these Terms shall not exceed the amount you paid for the App in the twelve months preceding the claim (which, for a free app, is zero Indian Rupees).
Nothing in these Terms limits liability that cannot be excluded under applicable Indian law, including liability for fraud, death, or personal injury caused by negligence.
These Terms remain in effect until terminated. You may terminate these Terms at any time by deleting your account (via Profile → Delete Account) and uninstalling the App.
We may suspend or terminate your access to the App immediately if you materially breach these Terms. Upon termination, your licence to use the App ceases, and your data will be deleted in accordance with our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of India.
Before initiating any formal proceedings, you agree to contact us at contact@khenitech.com and attempt to resolve the dispute informally for at least 30 days.

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes, we will make reasonable efforts to notify you within the App. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
Third-Party Beneficiary (Apple). You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms of Service, and that, upon your acceptance of the terms and conditions of these Terms of Service, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you as a third-party beneficiary thereof.
